BRIDGING THE GAP: INTEGRATING ARTIFICIAL INTELLIGENCE INTO KENYA’S ALTERNATIVE DISPUTE RESOLUTION FRAMEWORK– LEGAL, ETHICAL, AND PRACTICAL CONSIDERATIONS

Abstract

This paper builds on the existing promise of integrating Artificial Intelligence into the practice of Alternative Dispute Resolution in Kenya. With the proliferation of advanced Artificial Intelligence tools, which potentially influence the heightened adoption of Alternative Dispute Resolution Mechanisms within the jurisdiction, a union of sorts may no longer be overlooked. In due course, an unbridled employment of Artificial Intelligence tools in ADR will be witnessed. This paper, therefore, justifies the need for fastidious scrutiny as to the nature of the interplay between the two aforementioned disciplines. The paper subsequently argues that a meticulous approach in analyzing the legal, ethical, and practical aspects associated with the integration of Artificial Intelligence tools in ADR will effectively maximize the success and overall effectiveness of this integration. The paper takes note of the potential benefits of the integration of Artificial Intelligence in ADR. It also points to the legal, ethical, and practical considerations to be observed and subsequently suggests recommendations aimed at ensuring successful integration.
